Because we gather certain types of information about users of the Honda South Africa web site, we feel you should fully understand our policy and the terms and conditions surrounding the capture and use of that information. 1 INFORMATION HONDA SOUTH AFRICA GATHERS AND TRACKS
1.1 Honda South Africa gathers two types of information about users:
1.1.1 information that web site users ("users") provide through optional, voluntary submissions. These are voluntary submissions to receive our electronic newsletters, to participate in our message boards or forums, to e-mail a friend, from participation in polls and surveys and other services that Honda South Africa may provide to users of its web site from time to time; and
1.1.2 information Honda South Africa gathers through aggregated tracking information derived mainly by tallying page views throughout our web sites. This information allows us to better tailor our content to users' needs and to help us to better understand the demographics of our audience.
1.2 Submission of Optional Voluntary Information
We offer the following free services, which require voluntary submission of personal information by users:
1.2.1 Electronic newsletters policy (Dispatches)
We may offer a free electronic newsletter to users regarding marketing information and general news and topical issues at Honda South Africa, its partners and associates. Honda South Africa gathers the e-mail addresses of users who voluntarily subscribe to that electronic newsletter. Users may remove themselves from this mailing list by following the hyperlink provided in every newsletter that points users to the subscription management web page. Users can also subscribe to the electronic newsletters at the time of registration.
1.2.2 Message boards/forums policy
Users of the web site's Message Boards and Forums must register separately for these services (both are free of charge) in order to post messages electronically, although users do not need to register to visit the web site. During registration you will be required to supply a username, password and e-mail address.
1.2.3 "E-mail this to a friend"
Our web site users can choose to electronically forward an electronic hyperlink, page, or document to someone else by clicking "e-mail this to a friend". The user must provide their e-mail address, as well as that of the intended recipient/s. This information is used in the case of transmission errors and, of course, to let the recipient/s know who sent the e-mail containing the electronic hyperlink, page or document.
We may offer interactive polls on our web site from time to time to users so they can easily share their opinions with other users about important and contemporary issues. Opinions or other responses to polls are aggregated and are not identifiable to any particular user. Honda South Africa may use a system to "tag" users after they have voted, so they can vote only once on a particular question. This tag is not correlated with information about individual users.
Honda South Africa may occasionally conduct user surveys to better target the content on our web site and contained in our electronic newsletter to our audience. We sometimes share the aggregated demographic information in these surveys with our associates and partners. We never share any of this information about specific individuals with any third party.
1.3 Usage tracking
1.3.1 Honda South Africa tracks user web site traffic patterns throughout all of our web sites. However, we do not correlate this information with data about individual users. Honda South Africa does break down overall usage statistics according to a user's domain name, browser type, and Multipurpose Internet Mail Extension (MIME) type by reading this information from the browser string (information contained in every user's browser). Honda South Africa creates aggregate reports on user demographics and web site traffic patterns, but we do not track the usage patterns of individual users.
1.3.2 Honda South Africa sometimes tracks and catalogs the search terms that users enter in our Search function on the Honda South Africa web site as one of the measures of determining which items may be of interest to our users, but this tracking is never associated with individual users. We use tracking information to determine which areas of our web sites users like and don't like based on traffic to those areas. We do not track what individual users read, but rather how well each web page performs overall. This helps us continue to build a better service for you.
1.3.3 Our computer server may place a small data or text file called a "cookie" in the browser files of your computer when you access our web site. This data is stored on your browser. The cookie itself does not contain personal information although it will enable us to relate your use of this web site to information that you have specifically and knowingly provided. The only personal information a cookie might contain is information you supply yourself.
1.3.5 You can refuse to accept cookies from Honda South Africa by changing your privacy settings in your browser. 2 USE OF INFORMATION
2.1 As stated above, Honda South Africa may electronically collect, store and use, among other things, the following personal information of users:
2.1.2 birth date;
2.1.5 e-mail address;
2.1.6 IP address;
2.1.7 non-personal browsing habits and click patterns;
2.1.8 name and surname;
2.1.10 company; and
2.1.11 contact details.
2.2 Honda South Africa uses any information voluntarily given by our users to enhance their experience in our network of web sites, whether to provide interactive or personalized elements on the web sites or to better prepare future content based on the interests of our users.
2.3 As stated above, we use information that users voluntarily provide in order to send out electronic newsletters and to enable users to participate in polls, surveys, message boards and forums. We send out electronic newsletters to subscribers on a regular schedule (depending on the newsletter), and occasionally send out special editions when we think subscribers might be particularly interested in something we are doing.
2.4 Honda South Africa never shares newsletter mailing lists with any third parties, including our partners and associates.
2.5 As stated in 1.3 above, any information gained from web site usage tracking is used for compiling aggregated (non-specific) statistical information about web site browsing habits, click-patterns and access to the Honda South Africa web site.
2.6 Notwithstanding the aforementioned, we may use your personal or other information to send you information on new services, competitions, special offers or products that may be of interest to you and from time to time will post, e-mail or SMS information to you about us, our products and services, or our partners and their products or services. If you do not wish to continue receiving this information, you may contact us and we will remove you from our mailing list.
3 SHARING AND DISCLOSURE OF THE INFORMATION
Honda South Africa uses the above-described information to tailor our web site content, electronic services and features to better suit your needs. Honda South Africa may compile, use and share any information that does not relate to any individual user. We will, however, not share information about individual users with any third party, except to comply with applicable law or valid legal process, if the user consents in writing thereto, if it is in the public interest to do so or if it is necessary to protect Honda South Africa's rights.
4.1 Honda South Africa operates secure data networks protected by industry standard firewall and password protection systems. Our security and privacy policies are periodically reviewed and enhanced as necessary and only authorized individuals have access to the information provided by our customers. Honda South Africa shall take reasonable steps to secure the personal information provided by and collected from the users via the web site from unauthorised access and/or disclosure. However, Honda South Africa does not guarantee or warrant that the personal information provided by and collected from users shall be completely safe and secure.
4.2 Honda South Africa is not under any legal duty whatsoever to encrypt any content or communications from and to the Honda South Africa web site or to provide any digital authentication of any web page on the Honda South Africa web site.
4.3 The user hereby indemnifies Honda South Africa in the event that a third party or a hacker accesses and/or utilizes the user's personal information available on Honda South Africa's web site or its database, without Honda South Africa's knowledge or consent.
4.4 Any user who commits any of the offences referred to in sections 85 to 88 of the Electronic Communications and Transactions Act No. 25 of 2002 ("ECT Act") shall be liable for all resulting liabilities, loss or damages suffered and/or incurred by Honda South Africa and its partners. 5 OPT-OUT POLICY
We give users opt-out options wherever necessary and practical. Such choices include opting not to register to receive our electronic newsletters or other services offered on our web site and opting not to participate in certain interactive areas on our web site, which completely alleviates the need to gather any personally identifiable information from our users.

7 INTERCEPTION OF COMMUNICATIONS
7.1 Subject to the provisions of the Regulations of Interception of Communications and Provision of Communication-Related Information Act No. 70 of 2002 ("the RIC"), the user agrees to Honda South Africa's rights to intercept, block, filter, read, delete, disclose and use all communications (including all "data messages" as defined in the ECT Act) sent or posted by the user to the Honda South Africa web site or its staff and employees. 7.2 Subject to the provisions of the ECT Act and the RIC, the user agrees and acknowledges that the consent provided by the user in this paragraph fulfils the "writing" requirement.
8.1 The services referred to above, and any other service that Honda South Africa may from time to time provide to users of its web site, are provided in good faith and may be interrupted, unavailable, suspended or discontinued without notice to users at any time should Honda South Africa deem it necessary or expedient to do so. Users shall have no claim whatsoever against Honda South Africa for any damages or losses incurred by them as a result thereof.
8.2 Honda South Africa does not warrant or guarantee that the content and services available from the Honda South Africa web site will be true, correct or free from any material errors in all respects.
8.3 Information, ideas and opinions expressed by users on any of the services subscribed to by users or on the Honda South Africa web site should not be regarded as professional advice or the official opinion of Honda South Africa.
8.4 Honda South Africa's web site and the services offered thereon are provided on an "as is" basis and have not been compiled to meet users' individual requirements. It is the responsibility of the user to satisfy himself or herself, prior to entering into this agreement with Honda South Africa, that the content and services available from and through the Honda South Africa web site meet the user's individual requirements and is compatible with the user's computer hardware and/or software.
8.5 Users may post their personal opinions, comments, messages and ideas to the Honda South Africa web site and discussion forums, polls and surveys available on the Honda South Africa web site. Users hereby undertake not to post content to the Honda South Africa web site, discussion forums, polls and surveys that may be illegal, defamatory, profane, untrue, incorrect or harmful and Honda South Africa reserves the right to remove such posted content, should Honda South Africa deem it necessary to do so.
8.6 The user hereby indemnifies and holds Honda South Africa harmless against any liability, claim, damage or loss that may result from the user's posting(s) to the Honda South Africa web site.
